Privacy Policy
In this Privacy Statement; "We" or "Us" refers to My Gym (TAS) PTY LTD (ABN 50 858 746), the Operator, and its employees, agents and associated entities. "You" or "Your" refers to the Customer whose signature appears overleaf.
AGREEMENT TO DISCLOSE AND CONSENT TO USE
You acknowledge that you will, in completing this application for membership, disclose to us information about you, including information in relation to: a) Your health: and b) Your financial position.
By signing this Privacy Statement and Acknowledgement, you consent to us disclosing that information to:
Our staff/personal trainers (in case of health information), and,
Credit agencies (in case of financial information).
We agree that in dealing with information disclosed to us by you, we will deal with that information in accordance with the privacy principles set out below and with the Privacy Act 1986.
PRIVACY PRINCIPLES
We will only collect information that is necessary for what we do.
We will be fair in the way that we collect information about you.
We will tell you what we intend to do with information about you.
Where practicable, we will collect personal information directly from you.
If we collect information about you from someone else we will, wherever possible, make sure you are informed.
We will disclose information in ways that are consistent with your expectations or are required in the public interest.
We will ensure that information about you is accurate when we collect it or use it.
We will keep information about you secure
We will be open with you about what kind of personal information we hold and what we do with it.
Wherever possible we will let you see the information we hold about you and correct it is if is wrong.
We will limit our use of identifiers that government agencies have assigned to you.
DISCLOSURE OF PRIVATE INFORMATION TO A CREDIT INFORMATION AGENCY
By signing this Privacy Statement and Acknowledgement, you acknowledge and agree as follows:
We may give information about you to a credit reporting agency, for the following purposes:
aTo obtain a consumer credit report about you and/or
To allow the credit reporting agency to create or maintain a credit information file containing information about you.
The information about you, which we may give to a credit reporting agency, is limited to:
Identify particulars - your name sex, address (and your previous two addresses), date of birth, name of employer and driver’s license number.
Your application for membership and payment of membership fees by installments - the fact that you have applied for your membership and its values.
The fact that we have entered into a membership agreement whereby you agree to pay membership fees by installments.
Any membership fees which are overdue by more than 60 days, and for which debt collection action has started.
Advice that your membership fees are no longer overdue in respect of any default that has been listed.
Information that, in our opinion, you have committed a serious credit infringement (that is, fraudulently or shown an intention not to comply with your obligation to pay membership fee installments as they fall due for payment).
Dishonored cheques - cheques drawn by you for $100 or more which have been dishonored more than once.
That your membership has been terminated or has expired.
The information set out in Paragraph 2 above may be given by us before, during or after the term of your membership.
We may obtain information about you from a business that provides information about the commercial credit worthiness of persons for the purpose of assessing your membership application.
We may obtain a consumer credit agency report for the purpose of assessing your membership application.
We may exchange information with credit providers named in a consumer credit report issued by a consumer credit agency for the following purposes:
To assess an application by you for membership.
To notify other creditors of a default by you.
To notify other credit providers in relation to the status of your membership where you are in default with other credit providers.
To assess your credit worthiness. The information exchanged can include anything about your credit worthiness, credit standing, credit history or credit capacity that credit providers are allowed to exchange under the Privacy Act.
